A mock jury is an in-person or virtual discussion group or research study that consists of participants who hear fictitious arguments and evaluate sample evidence to help organizations and attorneys understand what actual jurors might think of a case. Mock jury focus groups, for instance, might include eight to twelve mock jurors who assemble to hear a practice presentation from one or both sides of a legal case. After lawyers present their case, a mock jury discusses the arguments and evidence. Typically, attorneys interested in a mock jury focus group watch the jury ‘deliberate’ from behind a one-way mirror.

What are Mock Trials Used For?

Mock jury trials are complete run-throughs of real-life cases. They include all elements of an actual case, including presentations, jury breaks, and discussion of the arguments and evidence. Legal research companies conduct mock jury trials to see how representative jurors may respond if a case goes to trial. When selecting mock jurors, legal research companies choose representative jurors similar to how attorneys choose actual jurors. Mock jurors usually live in the same region where the case will be tried, are registered voters, and have a valid driver's license. They typically are not members of law enforcement, the legal profession, or any branch of the judicial system.

A mock jury focus group is a representative jury for a mock trial. Mock jury focus group participants usually come from databases that research companies use for other consumer studies. To participate in a mock jury focus group, panel members fill out a survey screener or questionnaire to ensure they meet the criteria for the mock jury. Mock jury focus group researchers choose participants who do not have any bias toward the case being discussed. They refrain from pre-selecting mock jurors based on who might favor or not favor a case outcome, as attorneys do when selecting actual jurors. Legal research companies also act as a moderator for the mock jury trial.
